What you need to know

Three things most people get wrong.

Even with a good attorney, the home side of divorce has specific traps that come up over and over. Here are the three biggest.

Mistake 01

Confusing title with mortgage.

Being removed from the title (the deed) doesn't remove you from the mortgage. They're separate documents. You can be off the title and still legally on the hook for the loan — including damaged credit if your ex misses payments.

→ Lender approval is required to release one spouse from the mortgage. Almost always via refinance or assumption.

Mistake 02

Signing a decree before checking financing.

Many divorce agreements assume one spouse will refinance and keep the home. Then they discover the refinance won't qualify under current rates, income, or loan-to-value rules. Now they're locked into a plan that doesn't work.

Mistake 03

Using a regular agent for the sale.
