How mediation can help you during divorce

During mediation, divorcing couples work with an impartial third party on issues they need help resolving, such as custody, finances, and property division. Our experienced mediators know all about divorce law, and while they can’t give legal advice, they will help you better understand all of your options. The main goal of mediation is to reach a full agreement outside of court.

Reach an agreement out of court

In mediation, you and your spouse decide what is best for you and your family by designing an agreement that is tailored to your lives and unique situation. All that’s required is the desire and intent to cooperate with your mediator and spouse to review and resolve the legal and financial issues of your divorce.

Your mediator will…

  • Help you identify a fair middle ground on issues.
  • Diffuse tension and promote effective communication.
  • Summarize legal guidelines so your options are more clear.
  • Meet with you together or separately depending on your relationship dynamics.
  • Explore sustainable solutions that benefit you and your reorganizing family.
  • Propose various scenarios you can choose from to minimize financial and emotional costs.

You can always access a consulting attorney before or during mediation for individualized legal advice, support or document review.

First, get prepared – we can help.

Find the type of mediation that’s best for you

Different mediators have different communication styles. Some of our mediators are also attorneys, while others are not. Sometimes we use trained dispute resolution professionals or neutral financial experts, depending on the circumstances of your divorce. Ideally, you and your spouse will meet with the mediator together, but if you prefer, mediators can meet with you separately.

2. Prepare for Your Mediation Session

One key to success and to maximize your time is to prepare. Before you begin, you should do the following:

  • Download our guide How to Prepare for Divorce Mediation
  • Identify what is most important to you. Is it important for you to have your children full-time? Is it critical for you to stay in the family home? How much money do you need to live comfortably?
  • Consider your partner's point of view. Why would your partner want your children full-time? How attached is your partner to your home? How much money can your partner afford to pay you each month?
  • Prepare for worst-case scenarios. Are there compromises you are comfortable making? Consider what you are willing to do to reach a fair agreement.
  • Gather information. Paperwork like payroll stubs, childcare bills, mortgage bills, and more could help you make your case effectively.

3. Meet with Your Mediator via Phone or Zoom

Your meeting is meant to be efficient and on your timetable. Once you've worked out a section of your Agreement together, your mediator will guide you to what is next.
